The Family Class stream for immigration to Canada is broad and inviting. As mentioned, one of the main objectives of Canada’s overall immigration vision to assist with the reunification of families here. In one program in particular, The Spouse or Common-Law Partner in Canada Class, the objective is keeping a family united when already here in Canada. Spousal Sponsorship is available under 2 distinct scenarios:

  • To legally married spouses and common-law partners currently residing with an eligible sponsor inside Canada,
  • To legally married spouses, common-law partners, and conjugal partners living outside of Canada.

 

*Please note that there are instances where it may make very good sense to apply outside of Canada even if the sponsor’s spouse or common law partner is currently living in Canada.

Applicant Requirements

The Spouse or Common-law Partner in Canada program is available to spouses who have temporary resident status in Canada and of course, are not inadmissible. The idea here is to permit Canadian citizens and permanent residents to sponsor their spouses and common-law partners who are already residing with them in Canada. This assumes that the person applying is here in Canada under authorization such as a work or study permit. Holding temporary resident status is not a requirement of the application for a Spouse, Common-law Partner, or Conjugal Partner living outside of Canada, but all other eligibility requirements must be met.

 

 

There are advantages and disadvantages to each type of application. For instance, an “Inside-Canada” application might make the applying person eligible for an Open Work Permit, however there is no right of appeal should the application be rejected. The “Outside-Canada” application provides the right of appeal should the application be rejected, but there is no option for the open work permit. Sponsorship Requirements Under This Stream

Canadian citizens, permanent residents living in Canada, and persons registered in Canada as Indian under Canadian Indian Act may qualify to sponsor a foreign national spouse. For an inside Canada Class permanent residency application, you must be legally married or in a common-law relationship, AND you must be living with your partner in Canada.

 

As with any sponsorship application under the Family Class, the sponsor must meet a number of qualifications:

  • You cannot be receiving social assistance, other than help with disability.
  • You must not be incarcerated.
  • You cannot be in default of any previous sponsorship undertaking.
  • You cannot yourself have been the subject of a sponsorship undertaking within the past five years.

 

 

 

 

What Will I Be Responsible for in Sponsorship?

A sponsorship undertaking is a promise to provide financial support for the person you are sponsoring. This includes dependent children where applicable. While the length of sponsorship undertaking will vary depending on the family member you are sponsoring, the sponsorship undertaking for a Spouse, Common Law Partner, or Conjugal Partner will remain in effect for five years, even if your relationship changes. It is important to understand what you are promising to do! Mansouri Firm can make sure you understand exactly what you are signing up for.

We can help you clearly express your “love story”. We will also ensure that you understand which documentation you may need to gather/present as proof of your relationship, such as:

 

  • Statutory declarations from family and friends.
  • Shared utility bills.
  • Photographs of you as a couple.
  • Social media communication (Facebook posts, WhatsApp messages, etc.)
  • Mortgage or rent receipts
  • Joint bank accounts.
  • Cellphone call logs.

The Family Class stream for immigration to Canada is broad and inviting. In fact, one of the main objectives of Canada’s overall immigration vision to assist with the reunification of families here. Many newcomers to Canada who have been able to establish themselves here feel that this country would be a great place for their children and/or parents to come to. If you have obtained Canadian citizenship or permanent residency and you plan to bring your family to Canada, but you are unsure of how to go about this, please feel free to contact us to learn more.

 

 

In order to sponsor your family members, there are a number of requirements that must be met. Beyond holding Canadian citizenship or permanent residency you will need to demonstrate that you have established yourself economically, and that you are eligible, willing, and able to comply with a sponsorship undertaking. The period of time that you will be financially responsible for the applying person depends on which family member(s) you are sponsoring, but the experts at Mansouri Firm can ensure that you understand exactly what you are signing up for.

 

 

Like many other newcomers to Canada who are established, and capable of sponsoring  family members you may be able to help your spouse or common-law partner (whether currently in Canada or not), conjugal partner, children, and/or parents come immigrate to Canada. It may even be possible to sponsor grandparents to become permanent residents, though this is difficult. However, the recently introduced Super Visa may be a solution here.
