BC Skilled AND SEMI-SKILLED PNP
Provincial Nominee Programs (PNPs) grant Canadian provinces and territories the ability to nominate eligible individuals to become Permanent Residents of Canada. The British Columbia Skilled and Semi-Skilled PNP immigration programs were designed as a potential pathway for workers and international graduates who possess the skills, education and/or experience needed by employers in B.C. Generally speaking, the PNP programs exist with a goal of attracting individuals who are committed to live and work in a specific province, and ultimately become permanent residents of Canada. As Mansouri Firm’s offices are located in beautiful British Columbia, we have a lot of experience with the BC PNP in particular.
Canada’s PNPs are growing in importance, and the number of invitations to apply for permanent residence that stem from the PNPs is increasing exponentially. The provincial programs started in 1996, with just over 200 people arriving in Canada as a result of this initiative. In 2019, the PNPs are expected to combine to welcome more than 60,000 new Canadians, with the number continuing to rise each year. British Columbia’s allotment of applicants through its PNP program is typically among the highest of any province; but this does not guarantee that your application will be successful! British Columbia is one of the most attractive and popular destination provinces in Canada, so there is incredible interest in the BC PNP. There are also yearly limits on the number of nominations extended in each province, and British Columbia is no exception. This combination of factors means that the competition over nominations for the BC PNP is particularly high. However, if you are an eligible candidate for this program, you would not want to delay or diminish your chances of coming to Canada’s westernmost province because of things like errors in your application forms or missed deadlines. Mansouri Firm has the experience with the BC PNP to ensure that these will not be issues in YOUR case.
To be eligible for the BC PNP, you must:
- have accepted a full-time, permanent job in B.C. employer
- have been working full-time for your employer for at least nine consecutive months (with proper authorization) before applying
- meet minimum language and education requirements
- meet the qualifications of your job
- prove that you can support yourself, as well as any dependents should you be travelling with your family
- have legal immigration status in Canada
The BC PNP is connected to the federal Express Entry system, just like most other province’s PNPs. This opens things up for faster processing of applications for eligible skilled workers. To be eligible, you must meet the requirements listed above, and you need to be accepted into the IRCC Express Entry system.
An offer of employment or a degree completed in British Columbia are baseline requirements for applying to the British Columbia Nominee Program, but there are many additional requirements too. LMIA
A Labour Market Impact Assessment (LMIA) is an important process to understand if you are an employer planning to hire workers from outside Canada. In most cases (though there are exceptions), a Canadian employer will need to demonstrate that hiring a Temporary Foreign Worker (TFW) or a Foreign Skilled Worker (FSW) will not negatively impact a qualified Canadian citizen or permanent resident’s chances of obtaining the position in question. How does this work? Mansouri Frim can work with you to make sense of the whole process.
You as the employer initiate the LMIA. The assessment process begins once you decide to offer a position to the TFW or a FSW. You will submit an application to Employment and Social Development Canada (ESDC)/Service Canada. If it is determined by ESDC/Service Canada that no Canadian citizen or permanent resident is available to fill your job, you will receive a “positive opinion” (the LMIA was formally known as an LMO – Labour market Opinion). From here though, there is much more work to do. You, as the employer, will need to follow a number of conditions imposed by ESDC/Service Canada, and the TFW or FSW will still need to apply to Immigration, Refugees and Citizenship Canada (IRCC) for their work permit, a process which is related to, but separate from the LMIA. Without the positive LMIA, the next steps will not proceed.
ESDC will want to know about your recruitment process, and they have some rules regarding recruitment that must be complied with. You will need to demonstrate that the job offer is genuine and that the applicant is actually qualified. Similarly, TFWs and FSWs should be prepared to show IRCC that they are qualified for the position being offered.
Just as the immigration pathways for temporary work permits and permanent residence through Express Entry differ, so too do the requirements and evidence sought to support the respective LMIA applications. You, as an employer, may not even be sure if or when an LMIA is required. Canada’s immigration system is demanding and complex, but our team of immigration experts understand what needs to be done.
